What is the substantial presence test?

A

Must physically be present on at least:

  1. 31 days during current year
  2. 183 days during the 3-year period that includes the current year and the 2 years immediately before that
    * current year= all days counted (I.e 120 days)
    * 1st year= 1/3 of days (I.e 1/3 of 120=40)
    * 2nd year= 1/6 of days (I.e 1/6 of 120=20)
