What is lanham act?
This is the US federal trade mark legislation named after politician Fritz Latham who introduced the legislation.
Who may apply for a US TM?
It is necessary to have legal personality (ability to be sued) to own a US mark. The US does not have restrictions on nationality.
What bases must USTM have?
They must have one or more bases to them. Except 66;a) which is a standalone base. M MM
-section 1(a) - use in commerce base (currently using the mark)
- section 1 (b) intent to use basis ( intention to use in the near future)
- section 44( d) foreign priority bases
- section 66(a) - designation of the US in an international registration.
What language are USTM filed in?
English
What is a collective membership mark?
Are used with the sole purpose of indicating membership of a collective group.
What classification system does the US use?
International classification system
What are the special US classes?
Certification marks are classified into Class A for goods and class B for services, the rational behind this is that a variety of goods and or services could be being certified.
Collective membership marks are just signifying a membership of a collective and do not refer to specific goods and services they are all put into classs 200
What must be claimed for a US priority filing?
Usual 6 months from first filing, application date/ number country and section 44. (d) will need to be claimed as bases for the priorty claim.
What must a US filing include?
Name of applicant
Name and address for correspondence
Clear representation of the mark
Specification
Filing fee for at least one class
Fees for filing a US TM
Standard - 350 per class
Plus - 250 per class
How long does examination take at the USPTO?
Currently, usually around 8.5 months after filing
What is the deadline to respond to examination (office actions) in the US?
There is a 3 month deadline with a 3 month extension available to respond.
What type of registers are USTMs registered in?
- principle
Supplemental (rare to file on the supplemental register in the initial application and they offer far less protection
