Federalism
The system of sharing power between the state and federal government.
Enumerated Powers
Power given to the federal government that is listed in the Constitution.
Reserved Power
The powers kept by the states
Concurrent Powers
Powers that both the national and state governments share
Implied Powers
Those not explicitly listed the he constitution but are necessary to execute the powers expressly mentioned in the constitution.
“Necessary and Proper” clause
It allowed Congress to exceed its enumerated power to create laws if they were “necessary and proper.”
Supremacy clause
Federal law trumps state law
Commerce clause
Allows congress to regulate interstate commerce
US v. Lopez
Congress enacted the Free Gun School Zone Act under the commerce clause
McCulloch V. Maryland
Congress has the power to establish national bank and the states cannot tax it.
Unitary System
The central government hold all the power, and the state’s authority is derived from the federal government.
Confederate System
The state government government has more power than the federal government.
Fiscal Federalism
A system where the federal government distributes financial power to the state governments.
Federal Revenue Sharing
Federal government shares their money with state/local governments.
Categorical grants
Funds given to state governments for a specific purpose.
