federalism Flashcards
delegated powers
federal powers, powers granted to the federal government by the constitution
reserved powers
state powers, powers given to the states by the 10th ammendment
concurrent powers
both state and federal powers
expressed powers
powers explicitly explained in the constitution.
implied powers
necessary and proper, elastic clause, and commerce clause. powers that are not stated explicitly but obviously the federal government should have.
supremacy clause
ladder of laws, laws by the federal government and state governments are the laws of the land
fiscal federalism
money is power, taxing amongst other things is how the government should run
what is the purpose of separation of powers?
So no branch has more power than the other and it keeps each branch in check because each branch will have jobs to watch other branches, but they are also being kept in check.
Federalism is the balance of power between what two groups?
federal and state governments
Explain why the Antifederalists would NOT like the Necessary and Proper Clause.
Since necessary and proper clause is defined as the government sort of making their own decisions and acting upon something if they feel it is necessary, the anti federalists would not like this because they might feel the government should not be able to take matters into their own hands and make decisions without the people’s consent. They might think it is not in the best interest of the people.
popular sovereignty
people hold the ultimate power within a government
Limited government
No government is all powerful. The government must obey the law
Separation of powers
No branch will hold more power than another branch
