A

a system of government in which power is divided between a central authority and the various constituent units of the country

how is federalism written in the constitution?

A
  1. written into enumerated powers of each branch
  2. included in implied powers
  3. 10th amendment reserved all the remaining power to the states and the people
  4. supreme court would umpire all disputes between federal and state governments

types of federalism: DF

A

-dual federalism
-1780-1920s
-large focus on states’ rights
-federal gov. limited to money, war and peace
-also called layer cake federalism -divisions in political powers were clear cut
-e.g. in the post civil war era under Andrew Johnson, there was the emergence of legalised racial segregation which allowed states to decide on segregation laws

-cooperative federalism
-1930s-1960s
-increased federal involvement
-cooperation with the states so the federal gov. didn’t take too much power from them
-new federal departments e.g. defence, health
-e.g. civil rights act limited effects of states’ individual segregation laws
