What is federalism ?
The division of power between states and a central government . The United States needed a central government , but the states also wanted to have authority over themselves , so our forefathers wrote a constitution to represent all .
The United States Constitution developed a Central Government called ————–
The Federal Government.
What kind of issues does the federal government deal with ?
Issues that affect the whole country . Such as declare war on other countries , keep a military and negotiate treaties with other countries .
Do states have their own government ?
Yes! They handle the affairs of their state .
Where does the federal government( central government ) get all its power?
It gets its power from the constitution !
Any powers not designated to the Federal/ central government by the constitution are —————- for the states !
Reserved . State powers are reserved for the state . These powers are not given to the federal government .
What are concurrent powers ?
They are powers that are shared with both the state and the federal government .
What Government did United States try before the constitution was written , and what was the main problem with it ?
The Articles of Confederation . It was too weak ….. No strong central government . The states would ignore the laws it passed.
The constitution made sure this central government was not ignored so they added a supremacy clause . What was this supremacy clause and what does it mean?
This constitution , and the laws of the United States which shall be made in pursuance thereof … Shall be the supreme law of the land .
This means that the federal laws passed by congress cannot be ignored and will always be superior to state laws . No more weak Government for us 😊
What two powers does the constitution give congress?
Expressed and Implied powers .
What are expressed powers ?
Expressed powers are powers that are stated in the constitution
Each branch of the Federal government has expressed powers .
What are some examples of expressed powers given to the legislative branch / congress?
Coin money
Declare war
Establish immigration laws
What are some expressed powers given to the executive branch , the President?
Negotiating treaties with other countries
Nominating Supreme Court justices
Pardoning people who have committed a federal crime
Now let’s talk about implied powers . What are they ?
They are not stated in the constitution , but instead are inferred to carry out the expressed powers in article one of the constitution . The writers of the constitution knew they could not list all the powers that could be allowed by the Federal government .
What is the source of the implied powers?
The implied powers come from the Necessary and proper clause , also called the elastic clause , because it allows the constitution to stretch and grow as the times see fit .
