What is federalism ?

A

The division of power between states and a central government . The United States needed a central government , but the states also wanted to have authority over themselves , so our forefathers wrote a constitution to represent all .

A

The Articles of Confederation . It was too weak ….. No strong central government . The states would ignore the laws it passed.

The constitution made sure this central government was not ignored so they added a supremacy clause . What was this supremacy clause and what does it mean?

A

This constitution , and the laws of the United States which shall be made in pursuance thereof … Shall be the supreme law of the land .
This means that the federal laws passed by congress cannot be ignored and will always be superior to state laws . No more weak Government for us 😊

A

Expressed powers are powers that are stated in the constitution

Now let’s talk about implied powers . What are they ?

A

They are not stated in the constitution , but instead are inferred to carry out the expressed powers in article one of the constitution . The writers of the constitution knew they could not list all the powers that could be allowed by the Federal government .

What is the source of the implied powers?

A

The implied powers come from the Necessary and proper clause , also called the elastic clause , because it allows the constitution to stretch and grow as the times see fit .

What does the necessary and proper clause state ?

A

Congress may make any law that is “necessary and proper” for carrying out its expressed powers .

Our forefathers could not have known that the post office would need a web site to carry on with business , but they stated congress could establish post offices . The web site was necessary and proper !

Give an example of a time when congress did something that seemed to be not in their power ?

A

The Civil rights act of 1964 . They found a link with interstate commerce which they do have power over.

Struggles between federal and state powers continue today about guns, health care and much more !
