presidential appointment powers
can appoint ambassadors, federal judges, and other high-level officers with advice and consent of Senate
Congressional appointment powers
cannot give itself appointment powers; can vest power to appoint inferior officers in POTUS, courts, heads of departments/agencies
presidential removal powers
can remove high-level executive officers; Congress can statutorily limit POTUS’s power to remove all other executive employees
Congressional removal powers
can only remove executive officers through impeachment power
impeachment grounds
POTUS, VP, federal judges, federal officers
treason, bribery, high crimes and misdemeanors
impeachment process
1) House impeaches
2) Trial in Senate - need 2/3 vote for removal
presidential immunity
POTUS has absolute immunity from civil suits arising from official actions taken while in office; no immunity for actions prior to taking office
executive privilege
protects against disclosure of presidential papers and conversations; important gov’t interests in criminal cases can override
pardon power
POTUS can pardon those accused/convicted of FEDERAL crimes; cannot be limited by Congress
Article II presidential powers
1) make treaties
2) appoint ambassadors
3) act as Commander in Chief
