Can a member use a controlled substance while working?
Yes. Prescription drugs if the drug is prescribed or it’s an over the counter drug and it’s brought to the attention of the MRO by the member at least 2 hrs before reporting to duty.
Verified drug test or a alcohol test result of .04, what happens to the member?
- Taken out of service
- Disciplined by MTA
- Referred to SAP
- Required to pass drug and/or alcohol test before returning
A member with a verified positive result between .02 and less than .04 shall be subject to the following consequences:
- Cease performing functions
- Disciplined by MTA
- May return to duty on next scheduled work day but not less than 8hrs after confirmed test unless BAC is less than .02 on retest
In how many days and to who must a member report a conviction of violating a criminal drug statute in the workplace or anywhere else?
To the Chief of Police within 5 days of conviction
What training must a supervisor have in order to make the required ovbservations to send a member for a drug and/or alcohol test?
Substance Awareness Training
In addition to a alcohol breath test of .04 or more what else is needed to confirm it is failed test?
A second breath reading of .04 or higher
In regards to random testing a member can be tested when?
While on duty, right before going on duty and just after going off duty
A drug test that is reported as both negative and dilute require a second drug test?
Yes. If second test is same. No third test is required . 2nd test will be test result .
