Here’s an easy way to remember 408(b)(2) and 404(c) with simple mnemonics:

408(b)(2) → “B for Bill” (Fees & Bills)
• Think “B” in 408(b)(2) stands for Bill → It’s about fees and compensation disclosures.
• Service providers must show their bill (fees) to plan sponsors.
• Plan sponsors must check if the bill is reasonable.

👉 408(b)(2) = Fee Transparency Rule (Service providers → Plan sponsors)

404(c) → “C for Choice” (Investment Control)
• Think “C” in 404(c) stands for Choice → It’s about participant investment control.
• If participants have choice, fiduciaries aren’t liable for bad investment decisions.
• Employers must provide enough investment options & information to qualify for protection.

👉 404(c) = Investment Control Rule (Plan sponsors → Participants)
