What is the purpose of a PSO?
Is used when you believe it is necessary to take action to ensure the safety of a person at risk and there is insufficient evidence to make an arrest
After attending an incident and investigating an incident what four options are open to Police?
- No further action
- Issue a warning
- Issue a PSO
- Arrest
What is the maximum duration of a PSO?
5 days
What effect does have a PSO have on a parenting order issued by the court?
Any parenting order or agreement in place is suspended by for the duration of the PSO.
Who is defined as a person at risk?
- The person named in the order
- Any child residing with that person. (includes children of the person whom the order is to be issued to against whether the person at risk is also a parent or not).
Do police require the consent of a person at risk to issue a PSO?
No
Who can issue a PSO?
- Any constable may issue a PSO if authorised by a qualified constable
- A qualified constable means a constable who is of or above the rank of sergeant
Can a PSO be issued against someone under the age of 17?
No
When Police attend a family violence incident and make an arrest for a family violence offence, can a PSO be issued against the arrested person?
No, but Police should consider bail conditions be placed on the offender.
How long after a PSO is issued does the bound person have to surrender any firearms and/or firearms licence?
They must surrender them immediately.
When serving a PSO what four things MUST be explained to the bound person and the protected person?
- Purpose of the order
- effect of the order
- duration of the order
- consequences of contravening the order
When a bound person breaches a PSO and is brought before the courts, what are the three options that the court has for dealing with the breach?
- Release the bound person with no further action
- Direct police to issue another PSO to served on the bound person ASAP
- Issue a temporary protection order
