Child spends part of the year with each parent; parent with physical custody has decision-making authority
Shared custody
Declaration that a marriage never existed; based in common law
Annulment
Based upon statutory mutual obligation of support; can be awarded ONLY during the marriage
Spousal support
When custody is awarded pursuant to this act, all other states must honor the order under the Full Faith and Credit Clause of the U.S. Constitution
U.C.C.J.E.A. (Uniform Child Custody Jurisdiction and Enforcement Act)
Child spends time with each parent on an alternating basis; both parents have decision-making authority
Joint custody
Dissolution of a valid marriage based upon statutory grounds
Divorce
Form of joint custody where children remain in the family home
“Birds nest” custody
Each parent is awarded sole custody of one child, with visitation rights to the other child
Split custody
Include desertion, adultery, cruelty, and indignities
“Fault” grounds
Based upon the parents’ statutory obligation to support a minor child; cannot be punitive in nature
Child support
Paid in satisfaction of a support obligation imposed by the court and owed to a defendant’s ex-spouse
Alimony
One parent has legal and physical custody of the minor child; the other parent has visitation rights
Sole custody
Includes “consensual” and “non-consensual”
“No fault” divorce
