a marriage license must be obtained (more than 24 hours before ceremony); ceremony must be solemnized by an authorized party

Contract must
(1) be signed by the marrying parties and two witnesses;
(2) include the state of residence of each party and witness
(3) include the date and place of marriage
(4) be acknowledged before a NY judge

arises when two parties live together as though they were husband and wife for a prescribed period of time (but no ceremony) (not valid in NY unless from another state)
