Added sex as a protected class
1974 Amendment to the Fair Housing Act
Added familial status and handicapped as protected classes.
1988 Amendment to the Fair Housing Act
Defined as one or more individuals who have not reached the age of 18 being domiciled with a parent or person seeking legal custody; includes a parent who is pregnant
Familial Status
A physical or mental impairment or having a history of such impairment that substantially limits one or more of a person’s life activities; does NOT include drug addicts; DOES include alcoholics and persons with AIDS.
Handicap
Housing occupied by persons 62 or older, or housing occupied by at least one person 55 or older per unit, is exempt from familial status protection
Housing for the elderly
Inducing panic selling for financial gain by insinuating that a minority group is moving into the area .
Blockbusting
Channeling home seekers to, or away from, particular areas, based on race, color, religion, sex, or nationality .
Steering
Refusing to make loans or issue insurance policies within certain areas that are considered bad risk areas, regardless of the borrower’s ability to repay
Redlining
Exemptions
- Sale or rental of single family homes when owner does not own more than 3 homes at one time and an agent is not used, and discriminatory advertising is not used.
- Rental of rooms or units in an owner occupied 1 to 4 family dwelling
- Units owned by religious organizations if membership is not restricted on the basis of race, color, national origin, handicap, or familial status
- Lodgings in private clubs not open to the public, not operated commercially and when membership is not discriminatory.
Civil penalties up to $10,000 for first offense, $25,000 for another offense within 5 years; $50,000 for 2 or more within the past 7 years; may include actual damages
