What type of evidence can the defence attempt to exclude under s78(1)?

A

Section 78(1) may be used to attempt to exclude ANY evidence on which the prosecution propose to rely:

See, e.g., O’Loughlin [1988] 3 All ER 431 (depositions and documentary records); Newell [2012] EWCA Crim 650, [2012] 1 WLR 3142, considered at F17.67 (information provided by the defence on a plea and case management hearing (PCMH) form); Mason [1988] 3 All ER 481 (confessions); Beveridge (1987) 85 Cr App R 255 (identification parades); Deenik [1992] Crim LR 578 (voice identifications); and McGrath v Field [1987] RTR 349 (intoximeter readings).
