What is a child
The children (Scotland) act 1995 describes a child as
Any person who has not yet attained the age of 16
Any person who has attained 16 years but not 18 years and there is a supervision requirement in force
Lord advocates guidelines dictate that a child will only be prosecuted in the courts if ???
- The crime/offence would be dealt with on indictment or solemn procedure
- The alleged offence would result in a child 15 years or over being disqualified from driving
- The child is 16years but not yet 18 and reporter has terminated supervision order
What can a child be detained at police station ?
- It is impracticable to detain him/her elsewhere
- The child is so unruly that he/she cannot be detained elsewhere
- Be reason of their physical or mental health they should not be detained elsewhere
A mother always had parental rights. When does a father have parental rights?
- Married to mother at conception or thereafter
- He’s been given them by court order
- He has agreed rights and responsibilities with mother AND registered them through a legal process
- Altho not married - recorded on birth certificate and registered on or after 4th may 2006
When may a person without a firearm Licence borrow a Rifle?

From occupier of a private premises and
Use it on those premises
under the supervision of the occupier or his servant.
The borrower must be 17
Supervisor must hold firearms certificate.
People may have “total prohibition” from holding a firearms licence.
When ?
If they have been sentenced to young offender institution or imprisonment for a term of 3 or more years.
People may have “five year prohibition” from holding a firearms licence.
When ?
If they have been sentenced to young offender institution or imprisonment for a period of 3 months but less than 3 years.

It is an offence for any person under the age of 18years to be in possession of a section 1 firearm (GAS) unless?
- Acting as a gun bearer
- A member of an approved rifle club
- At a shooting gallery
Persons under 18 years of age and who have relevant firearms or shotgun (SSVCC) certificate may lawfully possess the weapons to which they relate but can only use them for following purposes ?
- As a slaughtering instrument
- For sporting purposes
- Vermin control, estate management, wildlife control
- Competition purposes
- Target and clay pigeon shooting.

Can a person under 18 possess a shotgun?
Yes. If they have been granted a shotgun certificate
If a person is under 15 year old they may not be in possession of an assembled shotgun unless they are either?
- Supervised by a person aged 21 or over (the supervisor does not need to hold a certificate)
Or
- The shotgun is so covered with a securely fastened gun cover that it cannot be fired
