Health professionals must have a clear understanding of their responsibilities, namely their
duty of care, when providing care to patients in any environment. Compare the legal expectations of a health professional that is providing care to a patient in a hospital and one who is acting as a good samaritan (i.e. off duty).
Health Records Act 2001
If you are off duty you do not have a duty of care, no obligation to engage care. But once you start care you are obligated to remain there until someone else takes over. At work you must continue are for a pf until handover. You can be held accountable for every action (negligence), even if you did something for the pt outside first aid boundaries and stuffed up you could still be held accountable.
The Health Records Act 2001 (Vic) has recently been introduced into Victoria. What are the purposes of the Act?

What are some reasons to keep quality records?
- The role of the patient record from a legal
perspective - Demonstrates greater involvement of patients
in making choices about care - Patients may access their records

- Clinical neglect
When might one use an incident report?
~ provide information of an unusual occurrence
~ record events / conditions to provide protection or
prevention of possible legal action
~ identify unsafe practice/ work environments
~ effectiveness of equipment/practises
