Explain John Locke’s Social Contract Theory, and how it influenced the
Texas Declaration of Independence?

A

Government is man-made
It is a contract between the governed (the people) and the government
Man is born in a “State of Nature.” Born into a state of nature where there is no government (The second treatise)
Thus, one is born into complete freedom

In this complete freedom, individuals have natural rights
HOWEVER, man leaves state of nature to protect natural rights, creates manmade government as an antidote to anarchy (the negatives of complete freedom)
THIS equals “social contract theory”
Government’s main purpose is to protect the natural rights
Thus, the gov has “authority,” not sovereignty
The citizens have given up their rights through laws, executives, and judges.

A

Liberty: The govt should only act to prevent harm to other

Individualism: The individual is more important than the collective

Skepticism about power: The individual is the best judge of their own interest

Rule of Law: No one is above the rule of law (the Constitution. It limits the gov’t).

Civil Society: Most social problems can be more effectively dealt with through voluntary organizations. Private organization used to solve public problems (church, family, organizations. Can solve problems better than the govt)

Spontaneous Order: Social orders are developed through society. NOT instituted by the government

Free markets: Limited gov’t, economic intervention. Don’t tell us what to wear to work, what to sell, what to say, etc.

Toleration: the belief that one should not interfere on things one disapproves of. Don’t force your opinions on me or anyone else (free speech)

Peace: Do not interfere with other countries. Non-interventionist view. Also, four freedoms: free movement of capital, labor, people, goods, and services

Each Spanish providence will have a Chief Spanish Head Military Officer (ALSO chosen by the Spanish monarchy).

NOT a constitution, JUST a government document (still in accordance with the monarchy).

This enables more Spanish control, BUT, Spanish Gov’t is actually limited in some capacity
