What is the European commission and what are their roles?

A

represents the interest’s of the EU as a whole. It proposed new legislation to the european parliament and the council of the european union, and it ensures that EU law is correctly applied by member countries

A

represents the governments of the individual EU countries. It is on of the main law-making bodies of the EU, along with the European Parliament

The Euroepan Parliament

A

represents the people of the EU. It is one of the main EU law-making institutions, along with the council of the European Union.

The court of Justice of the EU

A

upholds the rule of the EU law by ensuring consistency of application between EU countries settling disputes between EU governments and institutions and hearing cases that are brought before it.

The General Court

A

has jurisdiction at first instance over all direct actions. brought by individuals and EU countries, with the exception of those to be assigned to a judicial panel and those reserved for CJEU.

The European Council

A

composed of the heads of Stae or Government of the eU countries together with its president and the president of the commission. IT defines general political directions and priorities of the Union. It does not have any law-making function.

Where does European Law come from? (3 sources)

A
  1. Primary sources: e.g. the Treaty on European Union, Treaty on the Functioning of the EU, Eu treaties
  2. Secondary Sources: e.g. unilateral acts, conventions and agreements
  3. Supplememntary law: case law of the Court of Justice (CJEU), general international law, unwritten principles of law and justice.
