Anticipatory Breach
Clear indication before performance is due that a party won’t perform.
Anticipatory Breach - Effect
Gives the non-breaching party the option to sue immediately or wait until the performance date; Allows the non-breaching party to suspend their own performance.

To use Anticipatory breach we need A clear indication that a party will not perform the contract when performance is due.
