Erie Doctrine general rule
A
Under the Erie doctrine, a federal court sitting in diversity must apply substantive state law, but it will apply federal procedural law. If there is a federal directive on point, such as a federal rule of procedure or a federal statute, and it is valid, it will be applied. Under the Rules Enabling Act, a Federal Rule is valid if it deals with practice or procedure and does not abridge, enlarge, or modify a substantive right.
