Equal protection applies when a group of people are being treated differently.

Suspect Classifications – Strict Scrutiny
A
Race, religion, nationality, or physical disability. The government has the burden to prove the law is necessary to achieve a compelling government interest.

Intermediate Scrutiny
A
Gender. Government has the burden to rove the law is substantially related to an important government interest.

Rational Basis
A
Everybody who is not a suspect class will receive rational basis review. Under rational basis review, the plaintiff must prove the law is not rationally related to a legitimate government interest.
