Air Quality Regulations
- Federal Clean Air Act established the NAAQS (National Ambient Air Quality Standards) to protect public health
- NAAQS regulates facilities that produce air pollution. Facilities have to obtain permits and meet emissions standards
- Responsible Agency: PADEP
6 main air pollutants
Carbon monoxide, ozone, lead, nitrogen dioxide, particulate pollution, sulfur dioxide
Title 25 PA Code Chapter 102: Erosion and Sediment Control
- Approved in 1972, revised in 2010
- Purpose: protect surface waters in PA from sediment and stormwater pollution by use of BMP’s that minimize erosion and sediment and manage runoff
- Requirements: all construction requires an Erosion and Sediment Pollution Control Plan
- Responsible Agency: PADEP
PA Pesticide Control Act and the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)
- Purpose: requires pesticides to be registered / licensed for use in the US

- labeling, distribution, storage, registration
- classification of restricted use pesticides
- certification of applicators
- licensing pesticide dealers
- registration of pesticide application technicians
- notification procedures
Responsible Agency: PA Dept. of Ag
PA Stormwater Management Act of 1978 (Act 167)
Purpose - to reduce physical, chemical, and biological impacts to surface water from alteration of the land
Requirements - counties within watersheds develop stormwater manangement plans, permit requirements
Responsible Entity - local minicipalities
National Pollutant Discharge Elimination System (NPDES)
Purpose - regulate discharges to protect public health and aquatic life and assure that every facility treats wastewater
Some sources - animal feeding operations, mines / quarries, industrial wastewater, CSO (combined sewer overflow)
Requirements - dischargers must have a permit establishing pollution limits

system of conveyances used to collect stormwater (including storm drains, pipes, ditches) that is owned by a state, city, town, that discharges to a stream - commonly move polluted stormwater runoff into local water bodies
Title 25 PA Code Chapter 105: Water Obstruction and Encroachment
Purpose: assure proper planning, design, construction, maintenance and monitoring of water obstructions in order to prevent interference with flow
- protect water quality
Requirements: obtain permit from PADEP to perform any activity that encroaches on a stream or body of water
Federal Clean Water Act
Purpose: establishes basic structure for regulating pollutants into the water of the U.S, regulates water quality
Requirements: makes it unlawful to dump pollutants into water without a permit
