Regardless of age, what is the maximum mg of alc/100ml of blood?
80mg of alc/100ml of blood.
Before commencing a breath screening test (BST), what must you say to the driver?
“I require you to undergo a breath screening test without delay.”
You will require the driver to accompany you after a BST when:
- The driver refuses to blow.
- No BST device is available.
- The reading is “OVER 400”.
- If the person is under 20yrs and the reading is “UNDER 250” or “250 + OVER”.
What must you say to the driver?
“I now require you to accompany me to the…………. Police Station [or other such place] for the purpose of an evidential breath test, blood test or both.”
Followed by their Rights / Caution.
Before conducting an evidential breath test (EBT), what must you say to the driver?
“I now require you to undergo an evidential breath test without delay.”
What constitutes a positive result for a EBT?
- Over 400mcg of alc/ltr of breath.
- Under 20 yrs = OVER 150mcg of alc/ltr of breath.
- Under 20 yrs = UNDER 150mcg of alc/ltr of breath- infringement notice and demerit points.
If a driver EBT is positive, what must you do next?
- Advise them of their right to a blood sample taken.
- Read them “Advice of Positive EBT”
- Give Rights / Caution
- Give the driver 10 minutes (actually 12min) to decide whether they want a blood test.
What are the arrestable EBA offences?
- Fails or refuses to remain (at the place where the BST was undertaken until the result of the test was known).
- Fails or refuses to accompany (the person fails or refuses to accompany you without delay for an EBT or blood test or both).
- Having accompanied, fails or refuses to remain (having accompanied you, the driver fails or refuses to remain at the place the test is to be taken).
- Fails or refuses to give blood
- Fails or refuses blood (fails or refuses at request of medical practitioner).
