  • The driver refuses to blow.

  • The reading is “OVER 400”.
  • If the person is under 20yrs and the reading is “UNDER 250” or “250 + OVER”.

What must you say to the driver?

A

“I now require you to accompany me to the…………. Police Station [or other such place] for the purpose of an evidential breath test, blood test or both.”

Followed by their Rights / Caution.

  • Under 20 yrs = UNDER 150mcg of alc/ltr of breath- infringement notice and demerit points.

A
  • Advise them of their right to a blood sample taken.
  • Read them “Advice of Positive EBT”
  • Give Rights / Caution
  • Give the driver 10 minutes (actually 12min) to decide whether they want a blood test.

What are the arrestable EBA offences?

A
  • Fails or refuses to remain (at the place where the BST was undertaken until the result of the test was known).
  • Fails or refuses to accompany (the person fails or refuses to accompany you without delay for an EBT or blood test or both).
  • Having accompanied, fails or refuses to remain (having accompanied you, the driver fails or refuses to remain at the place the test is to be taken).
  • Fails or refuses to give blood
  • Fails or refuses blood (fails or refuses at request of medical practitioner).
