Eligibility determination for IEP

- 3 potential categories

A

determined by IDEA eligibility categories

  1. Educational diagnosis (13 disabilities included) -
    - regulated by IDEA
    - therapy is provided to assist child to benefit from SpEd
    - educationally relevant
    - must have edu. disability & demonstrate need for PT
  2. Medical diagnosis
    - regulated by health care & insurance policies
    - therapy provided to be as functionally independent as possible
    - is it medically necessary
    - any child may receive services (for IEP, children are not automatically eligible for PT services)
  3. Section 504 of Rehab act - if child does not qualify under IDEA, broadens ability to be eligible

autism, deaf-blindness, deafness, emotional disturbance, hearing impairment, intellectual disability, multiple disabilities, orthopedic impairment, other, specific learning disability, TBI, speech/language, visual impairment, dev delay

developmental delay is a broad category - must be changed to 1 of 13 others by kindergarten year to remain eligible
