What is the definition of Possession?
Any substance shall be deemed for the purposes of this act to be in possession of a person so long as it is upon any land or premises occupied by him or is used, enjoyed or controlled by him in any place whatsoever, unless the person satisfies the court to the contrary.
What is the definition of Traffick?
In relation to a drug of dependence includes prepare a drug of dependence for trafficking, manufacture a drug of dependence or sell, exchange, agree to sell, offer for sale or have in possession for sale, a drug of dependence.
What is a Drug of Dependence?
Means a substance specified in schedule 11 of the act. Whether natural or man-made.
What is the definition of Use?
Use in relation to drug of dependence means smoke a drug of dependence, inhale the fumes caused by heating or burning a drug of dependence or introduce a drug of dependence into the body of a person.

Summary Offence with a statute of Limitations of 3 years.
What is the Possess Drug of Dependence charge?
Indictable offence that can be triable summarily, used most often.
Where will all summary offences and offences triable summarily within the DPCSA be heard?
Magistrate’s Court.
What are the four charges within the DPCSA that must go to trial?
- trafficking in a drug of dependence - large commercial quantity
- trafficking in a drug of dependence - commercial quantity
- cultivation of narcotic plants - large commercial quantity
- cultivation of narcotic plants - commercial quantity
What is the special thing about section 82 DPCSA?
It has a dual power, the power to search and a power to detain a person for the purpose of carrying out the search otherwise the search power would be ineffective.
The power to search under DPCSA comes from what?
Suspecting on Reasonable Grounds.
What are the guidelines to handling suspected drug items?
- wear gloves and face masks at all times
- secure powders, pills, tablets and dried cannabis in Tamper Evident Audit Bags (TEAB)
- Fresh or wet cannabis plants should be stored in paper bags or hessian bags only
- Different types of drugs should be placed in seperate TEABs
- Syringes should be placed in sharps containers
- do not inhale, directly touch, or taste any substance
What is continuity?
Continuity is the process of proving that the drug you seized is exactly the same drug identified or analysed. To achieve this you must be able to state the whereabouts of the drug from the time you seized it until it is analysed.
What is a Volatile Substance?
A volatile substance is a substance that emits fumes that be be inhaled for immediate effects. The most common are spray paint, glue, petrol and cleaning agents.
Is use of Volatile Substances an offence?
No it is not, there is no power to arrest nor is there a power to demand name and address of young people.
Options may include:
- calling an ambulance or taking care of immediate health needs
- placing the child in care of a suitable person such as a parent or guardian
What are some common drug weights?
