Controlled drug
Any SPAM (substance, preparation, mixture or article) or CDA (controlled drug analogue).
Controlled drug analogue
Any substance with a structure substantially similar to a controlled drug. All classified as Class C.
Class B
Amphetamine, Cannabis preparations (resin and oil), MDMA, morphine and opium.
Guilty knowledge
KKI. Knew about the offence, knew the substance was a controlled drug, and intent to commit offence.
Produce
Bring something into existence from its raw materials eg cannabis to cannabis oil.
Manufacture
Process of synthesis. Combining raw materials to create new substance eg cooking meth.
R v Rua (creation)
The words ‘produce’ or ‘manufacture’ broadly cover the creation of controlled drugs by some form of process which changes the original substances into a particular controlled drug.
R v Rua (state)
Offence is complete once the prohibited substance is created, whether or not it is in a useable form.
R v Strawbridge
Knowledge will be presumed if there is no evidence to the contrary.
Police v Emerali
Possession doesn’t extend to some minute or useless residue. Must be useable quantity.
Supply
To furnish something that is needed or desired. Includes distribute, give and sell.
Distribute
Supply to multiple. Complete when defendant has done all that is necessary to accomplish delivery of the drug to others.
Administer
Cause drug to be taken into the system.

(Offer). Ready on request to supply the drug.
