Supply
To provide something that is needed or desired.
Includes:
Distribution - supply of drugs to multiple people.
Giving - handing the substance over.
Selling - typical concept of a sale. An exchange of the goods in return for valuable consideration.
Class A Controlled Drug
The controlled drugs as per Schedule 1 of MODA75.
Posing a very high risk of harm to individuals. E.G. Methamphetamine, cocaine, heroin, LSD, psilocybin (magic mushrooms)
Class B Controlled Drug
The controlled drugs listed in Schedule 2 of MODA75.
Posing a high risk of harm to individuals.
E.G. Amphetamine, cannabis resin, cannabis oil, MDMA, morphine, opium.
Class C Controlled Drug
The controlled drugs listed in Schedule 3 of MODA75 and includes any controlled drug analogue.
Posing a risk of moderate harm to individuals.
E.G. Cannabis plant or seeds,
Importation
Section 2 Customs and Excise Act 1996
Means the arrival of the goods in New Zealand in any manner, whether lawfully or unlawfully from a point outside New Zealand.
Administers
Introducing a drug directly in to another person’s system.
Offering
Must prove two elements:
- the communication of an offer to supply or Administer a controlled drug (actus reus)
- an intention that the other person believes the offer to be genuine (mens rea).
