While responding to an urgent duty job you travel through a 30km/h temporary speed road works area. Do you have a legal defence to travel above the posted temporary speed limit?
Explain
Yes. In the execution of your duty.
It’s high risk so recommended to travel about 30 when practical, ONLY exceed the limit when you have checked for all hazards.
Must prove it was when engaged in UDD and that you had lights and sirens going.
Do Police Officers have a defense to exceed speed limits?
Yes, in urgent duty and pursuit.
Must prove you were engaged in UDD and compliance with speed limit would limit execution of duty.
Prove you were operating lights or sirens or both.
While you are responding to a critical incident, you proceed through an intersection against a red traffic light. What are your obligations?
Must reduce speed to 20km/h and then proceed with red/blues flashing AND/OR siren activated, and taking care to avoid collision with pedestrians and other traffic.
When overtaking other vehicles, is there an exemption for police drivers on urgent duty response or pursuit to drive to the right of solid yellow no-passing lines?
Yes, only in the execution of your duty.
Because it is a high-risk manoeuvre it may be best to wait until after the no-passing lines.
Perform manoeuvre on slow or stationary traffic and only when way is clear.
Before using a police vehicle do you have to carry out an inspection of it?
Yes
Comms directs you to attend a motor vehicle crash at a busy intersection. It’s unknown whether there is any injury, but the road appears to be blocked. On the way you activate a speed camera. What would you need to prove to have the notice waived?
Would have to prove that compliance with speed limits, traffic signals, or stop or give way signs would be likely to prevent or hinder the execution of your duty.
As the passenger of a 2-person patrol involved in an URGENT duty response, what are your responsibilities?
Advise the driver about the ROUTE, the SITUATIONAL FACTORS, RISKS, and operate the RADIO if communications are required.
What is the overarching principle of the Urgent Duty Driving Policy?
No duty is so urgent that it requires the public or police to be placed at unjustified risk.
As the passenger of a 2-person patrol involved in a fleeing driver event, what are your responsibilities?
Assist the driver by operating RADIO, and advise driver of possible RISKS, and other considerations.
You may direct them to ABANDON the fleeing driver pursuit.
What type of Police Vehicle is a Category A vehicle?
A fully marked Police pack* or equivalent sedan or stationwagon fitted with electronic siren and light bar. This includes utility vehicles derived from passenger vehicles.
What type of Police Vehicle is a Category C vehicle?
Category A or B vehicles that are laden with 3 or more passengers or substantial load.
