How many domiciles may a person have at one time?
A person may have only one domicile, the acquisition of a new domicile extinguishes a former domicile
How is the domicile of a minor determined?
A minor’s domicile is the same as the domicile of the minor’s parents.
How is the domicile of a minor determined if the minor’s parents are divorced?
If a minor’s parents are divorced or sperated, the minor’s domicile is that of the parent with whom the minor lives
How is the domicile of incompetents determined?
Persons judged incompetent retain the domicile they had prior to their insanity or incompetence
What are the requirements for determination of domicile?
- the person’s physical present in a state
- person’s intent to remain indefinitely
What must a person asserting a change in domicile prove?
- a change in residence to a new state
- an intent to make this new state their permanent residence
What are factors proving intent to make a new state a permanent residence?
Factors to prove intent include:
1. owning real estate
2. voting
3. paying taxes to the state or town
4. having an in-state bank account
5. registering an automobile in the state
Can married spouses have separate domiciles?
