A Virginia court must consider the following factors when deciding type, amount, and
duration of spousal support:
(1) each party’s obligations, needs, and resources; (2) the duration
of the marriage; (3) the parties’ standard of living during it; (4) the parties’ ages and physical and
mental conditions and whether their conditions would make outside employment inappropriate;
(5) the parties’ financial and other contributions to the household; (6) their earning capacities
based on circumstances in the foreseeable future; (7) opportunities for a party to increase their
employability; and (8) any arrangement between the parties that kept either of them out of the
labor market. Adultery in Virginia bars an award of spousal support to an offending spouse
unless the denial of spousal support will amount of a manifest of injustice
