divorce reform Flashcards
what was the case until the 1960s
until the 1960s divorce law demanded evidence that one party had committed adultery
what made divorce impossible and only could be carried out by the rich
-gaining evidence required the rich to use private detectives + cameras but for others often impossible
what did jenkins belive about the laws for divorce
they were out of date
what was passed in 1969
the divorce reform act was passed in 1969
the divorce reform act allowed for ‘no fault divorce’ following
the ‘irretrievable breakdown of a marriage’
couples could divorce if:
-they had lived apart for 2 years + both partners agreed to a divorce
-they lived apart for 5 years and one partner wanted the divorce
why were not all mps in favour of divorce reform act?
due to religious reasons= marriage still viewed as sacred + significant
following the reforms there were?
(impact of reforms)
huge increase in the number of divorces
in 1950 there had been
fewer than 2 divorce decrees per 1000 married couples in England and Wales
by the mid 1970s how many marriages ended in divorce
10 in every 1000 marriages ended this way
- growing female independence accounts for this but so does the divorce act
