What are the requirements of diversity jurisdiction?
A court has subject matter jurisdiction via diversity jurisdiction if 1) there is complete diversity between the Plaintiff(s) and Defendant(s) and the amount in controversy is greater than $75,000.
How is a claim for injunctive relief valued for purposes of meeting the amount in controversy requirement of diversity jurisdiction?
A claim for injunctive relief may be valued by the benefit to the plaintiff or the cost of compliance to the defendant.
Who can aggregate claims to meet the amount in controversy requirement?
One plaintiff can aggregate all of her claims against one defendant to meet the amount in controversy requirement. Also, one plaintiff can aggregate all of her claims against multiple defendants if they are jointly liable.
How do multiple plaintiff’s meet the amount in controversy requirement?
If there are multiple plaintiff’s’ generally, each plaintiff’s claim must meet the AIC requirement separately.
What types of cases does a federal court NOT have diversity jurisdiction over?
Probate actions and Domestic relations (divorce, child support/custody).
