there was no physical conduct that accompanied her words to constitute disorderly conduct. Specifically, the Officers received a dispatch to investigate two black males in a white dodge, no questions were asked pertaining to the actual investigation, Officers stopped Petithomme on private property, demanded identification, allowed Petithomme to go into her home for said identification, searched her vehicle without authorization, Petithomme was upset at the unlawful search, Officers repeatedly yelled at her, 2 or 3 neighbors observed the incident with no reaction, 25 Petithomme produced the identification, Petithomme was immediately arrested after she said, “Here’s my identification,” and Martin stated the reason for the arrest (i.e. he did not like the way she gave him the identification and how would he explain the search of the vehicle).

Thus, when conduct occurred that forms the basis for the disorderly conduct charge, the Officers were no longer legally detaining Plaintiff to conduct an investigation.
