What is the main purpose for Pre-Action disclosure?
Pre-Action disclosure is made when potential Claimant needs to look at documents belonging to potential D to decide whether or not there is a viable case
What are the requirements for Pre-Action disclosure?
- Both applicant and respondent must be likely to be a party to proceedings
- The material(s) to be disclosed must be likely or must have been in the possession, custody or power of the potential defendant
- Materials must be relevant to the issue
Why is Pre-Action disclosure desirable?
- Determine if proceedings can be avoided
- Any proceedings can be dealt with fairly
- Costs can be saved
