When can a duty to preform be discharged?
A
Impracticability
- Illegal, destroyed, dies, impractical.
- To be impractical, must be; (1) an unforeseeable event; (2) non-occurrence of the event was a basic assumption of contract; and (3) party seeking discharge not at fault.
