What does S57 if CJA state
A person who kills or is a party to the killing of another is not to be convicted of murder if that person was suffering from an abnormality of mental function
What must an abnormality of mental function prove
A recognised medical condition
An impaired ability to: understand nature of his conduct, from rational judgement, exercise self control
Provide an explanation for D’s act and omissions
What is an abnormality of mental function
When the state of mind differs from that of an ordinary human that a reasonable person would deem it abnormal
