What is a design?
A design is the appearance of the whole or part of a product
In order to be registrable, a design must have?
Novelty (be new) and individual character
How to apply for a registered design?
- GB registered design - Apply to UKIPO
- Hague Agreement - via WIPO
- Other countries - Apply to relevant intellectual property office
What are the minimum requirements to secure a filing date for a GB registered design?
- Applicant details
- Representations of design
- Payment of registration fee
What form is filed for filing a GB registered design?
Form DF2A
How can you file GB registered design?
- Filed online
- By hand
- By post
- By fax
How long can publication be deferred for on a UK design?
Up to 12 months if requested on filing
If publication has been deferred, when must publication be requested by and what other actions must be necessary?( GB)
Within 12 months of the filing date and publication fee must be paid
Can GB designs claim priority from earlier GB registered designs?
No
When are certified copies of priority application due on GB design?
Within 3 months of the filing date
When are any translations due on a GB design?
Within 3 months of subsequent communication from UKIPO
What is considered when the design enters examination?
- Are the filing formalities met?
- Is it a design?
- Is it moral?
- Is the Applicant entitled to file in UK?
- Does it contain any unauthorised emblems/symbols?

What is the deadline for filing a priority claim to a GB design?
Within 6 months of the priority date
When must be renewal fees be paid on a registered GB design?
Every 5 years from anniversary of registration
When can the renewal fees be validly paid? (GB design)
- 6 months early
- 6 months late payment (1st month free and surcharge for each additional month)
