It is the process used to regulate occupations. Generally a governmental agency

They are standards that govern the conduct of a group of professionals
Define Scope of Practice.
Range of duties and skills that paramedics are allowed to expected to perform
What is a Duty to Act?
Formal contractual or informal obligation to provide care
What is a Breach of Duty?
An act or an inaction that violates the standard of care expected from a paramedic
What are Actual Damages?
Refers to compostable physical, psychological, or financial harm
Define Proximate Cause
Actions or inactions of a paramedic that immediately or worsened the damage suffered by the patient
Define Malfesance
The performance of a wrongful or unlawful act by a paramedic
Define Misfesance
Performance of a legal act in a harmful or injurious manner
Define Nonfesance
It is the failure to perform a required act or duty
Define Informed Consent
It involves a conscious, competent patient that has been informed of an assessment, treatment, options and outcomes
What is Expressed Consent?
It is the verbal, non-verbal, or written communication by a patient wishing treatment
Define Implied Consent
For a patient who is mentally, physically or emotionally unable to give consent
What is Involuntary Consent?
It is consent for treatment granted by a court order
Define Abandonment
It is terminating care with a patient without any given care
Define a Minor
Anyone under the age of 18, you required parent or legal guardian consent to provide treatment
Who is a Mentally Incompetent Adult?
Anyone over the age of 18 who cannot make legal decisions. You will require legal guardian for consent
What is Withdrawal of Consent
A patient may withdraw consent for treatment at anytime, but it must be an informed refusal of treatment
What is Medical Direction
EMS systems must retain a medical director. Paramedic’s practice under an extension of the medical directors license
