CDR - Call Detail Records

A

STANDARD

  • Only need a subpoena to get, No SW or PC needed, just case relevance
  • Used to establish patterns of who target communicates with and how often
  • What you get
    • Get incoming and outgoing calls,
    • duration of call
    • time stamp of the call
    • type of call (text, picture, voice call)
    • DO NOT Get contents of the record (Hear convo, see pics, read texts, etc.)

CDR- Historical

  • Need PC- SW otherwise violate 4th amendment
  • Use Tass Template
  • Get tower pings and download info into ZET-X to map out

A
  1. Immediate danger of death or serious bodily injury to any person.
  2. Conspiratorial activities characteristic of organized crime.
  3. An immediate threat to a national security interest; or
  4. An ongoing attack on a protected computer

A
  1. Victim, witness suspect contact
  2. Forensic requests completed
  3. Photo Line ups are completed
  4. Video/Pictures picked up
  5. Evidence is impounded
  6. Contasct w witness/suspects to include contact info
  7. Refusal of prosecution by witnesses or the DA
  8. Unit assinged if case is transferred to a different investigative unit
  9. SW, Penn or Tittle III applications
  10. Unique investigave techniques used during investigation
  11. Date, Time and and final disposition of case

Steps to a Tele SW

A
  1. Parts of the Tele
    1. Application/Affidavit (Template)
    2. Duplicate Original SW
    3. Recording
    4. Return Service
    5. Transcription
  2. Verify/Confirm PC
  3. Deconflict wit RISSafe (Vehicle, Person, Locations, EVERYTHING)
  4. Draft Telephonic Application and Affidavit
    1. Establish nexus between the place searched and the items to be seized
    2. Nighttime clause & Sealing, turnover order
  5. Double check to make sure details are correct (address, person, vehicle, etc.)
  6. Have partner Red ink it (2 people if possible)
  7. Give to Sgt for review
  8. Contact on-call DA for review
    1. ask for personal number for future updates, build relationship
  9. Call On-Call Judge for approval
    1. Turn on recorder with witness present (2 recorders)
    2. Ask if they would like the duplicate read as well
  10. If denied will not shop judges, contact Sgt
  11. Service of Warrant
    1. Static
    2. Low Risk (Non-Swat)- Need IAP
    3. High RIsk (Swat)- Need IAP
  12. Leave return describing items seized
  13. Leave Copy of SW Application/Affidavit or Seal at Location. Take pics
  14. Secure premises
  15. Impound evidence
    1. Complete OR
  16. Return Duplicate Original SW, transcription, recording and or Seal to Courthouse within 10 days
  17. Send copies to Records
