When can the surety raise defences against the creditor?
A
If the principle obligation is illegal or there wa s a mistake, or duress for example

What is benefit of excursion
A
The surety may claim that the creditor must exhibit all his legal remedies on the principle debtor first

A
- If security has renounced the benefit
- The surety has bound himself as surety AND co-principle debtor
- The principle debtor has been sequetsrated or left the country and can’t be found
