Defences Flashcards
1
Q
Involuntary intoxication as a defence
A
Can be a defence to any offence (basic or specific) so long as the D lacks the MR.
2
Q
Intoxication and mistake
A
The defence of self-defence fails when D’s mistaken belief is induced by voluntary intoxication. Additionally, the D can only rely on self-defence if their reaction doesn’t exceed that of a sober person.
