What is the deadline for submitting the account to HMRC (regarding the deceased’s estate)?
12 months from the end of the month in which the date occurred
Deadline for paying IHT due
6 months from the end of the month in which the death occurred, after which interest is payable on unpaid tax
When should PRs distribute estate if they anticipate an IPFDA claim?
Delay by 10 months (6 months to issue claim and 4 months to serve notice)
When should PRs distribute if they have put out a s27 notice?
Do not distribute until 2 month deadline for being notified by claim
What are the time limits for an IPFDA claim?
An application under IPFDA cannot be made more than 6 months after the date of grant of representation
What is the executor’s year?
PRs should complete administration within 12 months of date of death
Appointing an attorney
After executor has obtained a grant, a PR may delegate their functions to an attorney for a maximum of 12 months
NCPR 20 statutory order of priority
NCPR 20: statutory order of priority to be appointed as administrator under grant of letters of administration with will
a) executor
b) trustee of residuary estate
c) any residuary beneficiary, or if partial intestacy, a beneficiary under intestacy
d) PRs of anyone in (c)
e) any other beneficiary or creditor
f) PRs of anyone in (e)
NCPR 22 order of entitlement to be appointed administrator
NCPR 22 = intestate
a) surviving spouse or civil partner (must wait 28 days after deceased’s death)
b) children of deceased
- if child is a minor, an adult is appointed to act on behalf of minor

e) half blood siblings
