Drug Trafficking
Trafficking in drugs involves actively soliciting individuals to purchase drugs with the intent to deal drugs.
Robbery 1st Degree
Robbery in the first degree occurs when a person takes property from another by force or threat of force, intending to permanently deprive the victim of the property, and uses a deadly weapon or dangerous instrument during the commission of the robbery.
Conspiracy 1st Degree
Conspiracy consists of forming an agreement to commit a crime and one of the co-conspirators taking at least one overt act in furtherance of the conspiracy. First-degree conspiracy involves agreeing to commit a Class A felony.
Menacing
Menacing involves placing another in reasonable apprehension of physical injury by movement of the body or an instrument.
Assault 1st Degree
Assault is the causing of injury to another by force and without the person’s consent. It becomes first-degree assault when the assault occurs during the commission of a felony.
Murder 1st Degree
First-degree murder is the intentional taking of the life of another. It becomes first-degree murder when undertaken during the commission of another felony.
Participation in Gang Activity Rule Statement
Participation in gang activity requires the commission of three or more offenses within a period of not less than three months by persons identified as participants in gang activity by virtue of a common name, similar clothing, and use of symbols.
Attempted Murder 1st Degree
Attempted first-degree murder involves an attempt to intentionally take the life of another while in possession of a deadly weapon and during the commission of a felony.
Destruction of Evidence/Obstruction of Justice
Destruction of evidence/obstruction of justice involves knowingly destroying material evidence of a crime to impede a law enforcement investigation.
Criminal Solicitation (Second Degree)
Criminal solicitation involves encouraging another person to commit a crime. Second-degree solicitation applies when the crime solicited is a Class B-G felony.
Harboring a Fugitive
Harboring a fugitive involves taking in and giving safe harbor to a fugitive from justice sought for the commission of multiple felonies, including murder.
Possession of a Firearm by a Person Prohibited
Possession of a firearm by a person prohibited occurs when an individual who is on probation (or otherwise prohibited from possessing a firearm) possesses a firearm.
Terroristic Threatening
Making a statement that would lead another to fear death or physical injury.
Reckless Endangering 2nd Degree
Reckless endangering in the second degree occurs when an individual’s reckless conduct puts another at risk of injury. If the conduct puts another at significant risk of death, it could be elevated to Reckless Endangering 1st Degree.
Possession of a Deadly Weapon During Commission of a Felony
Using a deadly weapon while committing a felony.
Carrying a Concealed Deadly Weapon
Carrying a deadly weapon concealed without a license.
Wearing Disguise During Commission of a Felony
Wearing a disguise during the commission of a felony.
Aggravated Menacing
Using a body movement to put another in reasonable apprehension of imminent injury. The use of a gun elevates this to aggravated menacing.
Offensive Touching
Intentionally touching another in a way that would be offensive to a reasonable person.
Theft
Taking or exercising control over the property of another. If the amount stolen is below a certain threshold, it is a misdemeanor.
Theft of a Payment Card
Stealing another person’s payment card.
