The Supreme Court recently struck down a provision of Income Tax which denied exemption to Sikkimese women who have married non-Sikkimese.

Section 10 (26AAA) of the Income Tax Act, 1961 excluded Sikkimese women who have married a non-Sikkimese after 1 April, 2008, from getting exemption under the Act. The Top Court observed that the section is totally discriminatory and violative of Articles 14, 15 and 21 of the Constitution of India.
