Mitigation (case)
Causation (definition)
D only liable for damages he caused
Remoteness (definition)
D only liable for what was “reasonably foreseeable” as a result of the breach.
Mitigation (definition)
C under a duty to minimise losses
How is loss calculated?
Loss is determined either through “loss of expectation” or “reliance”. Claimant can choose between either but cannot claim both losses.
Loss of expectation (definition)
C loses out on what they were expecting from the contract. They will be awarded enough to put them in a spot where they either get what they intended to get or where they would have been before the breach.
Loss of expectation (case)
Golden Victory
Reliance case (definition)
The courts seek to put C in the position they would have been before the contract was made.
