What is the main principle of Care and Protection for a CYP?
The welfare and interests of the child or young person shall be the first and paramount consideration
What is section 39 of the Children, Young Persons and Their Families Act 1989?
Place of safety warrant:
- You may enter and search (by force if necessary)
- RGTB that the CYP has or is likely to suffer
- ill-treatment, serious neglect, abuse, serious deprivation or serious harm AND
- Remove or detain the CYP
- Place the CYP in CYFS
What is section 42 of the Children, Young Persons and Their Families Act 1989?
Search without warrant:
RGTB
Critically necessary to protect CYP from injury or death
Enter and search
remove or detain
Place CYP with CYFS
+ Statutory obligations when using this power
Produce evidence of your identity
State you are using S42 of CYPF Act 1989
Inform Commissioner within 3 days
What is section 48 of the Children Young Persons and Their Families Act 1989?
CYP Found Unaccompanied
Found by Police Unaccompanied
Physical or mental health is being or likely to be impaired
Police may take the CYP
With their consent
Deliver into custody of parent, guardian or other person
With no consent or caregivers unwilling
Place CYP with CYFS
In regards to children, what does the Summary Offences Act 1989: Section 10B state?
Being a parent or guardian or person having the care of a child under 14
Leaves that child
without making reasonable provision for the supervision and care of the child
for a time that is unreasonable or under condtions that are unreasonable having regard to all the circumstances
