Section 6: paramount principle
“The welfare and interests of the CYP should be the first and paramount consideration”
Section 14: identifying CYP that are in need of care and protection
M - MAJOR differences in wel being between the g and CYP
A - the CYP is likely to be sexually, emotionally or physically ABUSED
U - guardian is UNABLE OR UNWILLING to control the CYP
E - EXTENT of the child’s offending is such that there are concerns for the well being
Section 39: you have time
You have information that abuse or neglect is taking place AND you have time to apply for a warrant without the CYP being further abused.
Section 42: your in the poo
You have information that abuse is neglect is taking place AND it is CRITICALLY NECESSARY that action take place immediately so as TO AVOID INJURY OR DEATH to the CYP
Section 48: stay up late
Where a CYP is found by Police UNACCOMPANIED by their guardian or other person.

In a situation in which their PHYSICAL or MENTAL HEALTH is being, or likely to be IMPAIRED

A member of Police may (using reasonable force) take the CYP
I
With the CYP’s consent DELIVER them into the custody of their parent - guardian - other person
I
If no consent is given or caregivers are unwilling to take them, PLACE the CYP into the care of CYPFS
Section 10B
Being a Parent or Guardian or a person having care of a child under the age of 14 years

Leaves that child

Without making reasonable provisions for the supervision or care of the child

For a time or under conditions that is unreasonable having regard to all the circumstances
