What is Criminal law?
Implemented by the state in the form of Statutes to regulate the behavior of the community; it is found in the denial code Chapter 84.
Summary Offenses
Less serious offenses
The defendant is arraigned and tried in the Magistrate’s Court by Magistrates alone; except that it is a juvenile case.
Triangle either way offence
The defendant has the right to elect whether he/she wishes his matter to be heard in the Magistrates or Supreme Court
What is an Indictable Offence?
These are the most serious offenses generally sent to the Supreme Court by way of a Voluntary Bill of Indictment
Voluntary Bill of Indictment (VBI)
Given the nature of the offense, the defendant is informed that the Magistrate can not grant bail but he can apply to the Supreme Court for bail. He is remanded to the Dept. Of Corrections
