how many police apprehensions police deal with do not proceed to charge
40% do not make it to sentencing - diversions and warnings
if you offend and you are contrite about actions
you are diverted out and there is no record of offending
what is the two weakness of sentencing in the CJS
1 pakeha are more likely to be diverted than maori, particularly in the context of cannabis related offending or common assault
2 police exercising discretion without much supervision can be problematic
when people are sentenced
they are held accountable and a judge public denounces their conduct
what cases end up where
the district court hear all criminal cases expect for category 4 offences that go straight to the high court ( murder, mansluaghter, treason and terrorism)
