Explain Section 13 - Criminal Disclosure Act 2008
What must the prosecutor disclose and when?
A
Prosecutor MUST disclose to the defendant as soon as reasonably possible AFTER a NOT GUILTY PLEA:
Any relevant information including:
- Copy of statements made by prosecution witnesses
- Copy of briefs of evidence for prosecution witnesses
- The name and if authorised address of anyone interviewed by the prosecutor who gave relevant information but the prosecutor does not intend to call. Any statement or account of that interview.
- Any known conviction s of a prosecution witness that may affect their credibility
- A list to exhibits proposed as evidence
- A list of relevant exhibits in possession of the prosecutor that the prosecutor does not propose as evidence
- A copy of information supplied to the prosecutor in connection with the case by someone the prosecutor proposes to call as an expert witness
- A list of any relevant info that the P refuses to disclose to the defendant together with the reason and if requested grounds in support of the reason.
